IMPORTANT NOTICE
When signing up, please note the following:
- Weekly Training Fee: You will subscribe to a weekly fee contract for your chosen training program.
- 1-Year Association and Support Membership: This is a mandatory annual fee of $100 per person, which covers member benefits, grading, and administrative support. It is billed separately and renews automatically unless cancelled.
- Gear Requirements: All students must have the required training equipment and uniform to participate. These can be purchased through KMS or from external vendors, provided they meet our standards.
TERMS AND CONDITIONS
GLOSSARY
1. Association/Support Membership Fee: The 1-Year fee that covers association, support, and benefits for 12 months.
2. Program/Training Fee: The ongoing weekly fee for participating in specific training programs or classes. This fee is typically set for the entire training period, usually 48 weeks, and is paid in weekly instalments.
3. KMS App: The application used for booking and tracking attendance in classes.
MEMBERSHIP AND FEES
4. Membership Commitment: The 1-Year Association/Support Membership Fee covers association, support, and benefits for 12 months, including the first two gradings, certificates, belts, patches, and other benefits. This fee is to be paid upfront and signifies a commitment to train with us for one year. This membership cannot be paused or stopped and covers only the one-year association and its benefits. Notices regarding membership should be sent via email to info@kravmagasystems.com.au.
5. 7-Day Cooling-Off Period: New members have a 7-day cooling-off period during which they can cancel their membership. If the 1-Year Association/Support Membership Fee has been paid, it will be refunded in full. Any equipment purchased can also be refunded as long as the items are completely unused. Alternatively, equipment and memberships can be exchanged or gifted to someone else.
6. Ongoing Training Costs: The Program/Training Fee, whether online or in-school, is to be paid weekly. Payment is made via credit card or direct deposit automatically through the Mindbody Online System. Payments are scheduled in line with the training date:
- Monday: Marsden Park
- Wednesday: The Ponds
- Thursday: Wentworthville
While flexibility in payment dates can be arranged if required, it is not ideal and should be minimised.
7. Payment Policy: Failure to make payments for the Program/Training Fee will result in the cancellation of your spot in the training program and forfeiture of your position to someone on the waiting list. Payments for the Program/Training Fee will continue unless you put your program on hold, cancel, or have your program revoked due to prolonged absence or termination for other reasons. The Membership Fee is non-refundable and will continue regardless of program participation.
8. Holding Your Spot: Payment for the Program/Training Fee secures your spot in the class. Your position is guaranteed as long as payments are made consistently and the terms and conditions are followed.
9.Holiday Closures: KMS closes for 2-4 weeks during the year-end holiday period, typically from December to January. During this period, your weekly Program/Training Fee will be paused unless alternative training is organised, for which you will be notified. Alternative training during this period will be offered at a premium equivalent to your weekly fee.
10. Flexible Pass Options: If you cannot commit to the full program and might miss classes, you have the option to purchase a 5 or 10 class pass. These passes offer flexibility for those with unpredictable schedules, allowing attendance without a full commitment. The price for these passes is higher to account for this flexibility.
Active 1-Year Association and Support Membership
11. All students are required to maintain an active 1-year Association and Support Membership, which costs $100 per year.
12. This membership renews automatically unless cancelled. Notices of cancellation must be sent via email to info@kravmagasystems.com.au.
13. The Association and Support Membership covers benefits, including access to free member events, grading, certificates, administrative support, and ongoing association benefits.
Short-Term Courses
14. Short-term courses do not require membership and are not subject to all the standard Terms and Conditions.
15. These courses have a 5-day cancellation window. If you book and pay but decide to cancel within this time, a refund will be provided.
16. After the 5-day window, refunds are not available. However, you may transfer your spot to another person or move your credit to a different course or class.
17. If you miss a session, you may attend a similar session within the course schedule if available. At worst, notes summarising what was covered in the missed session will be provided.
18. It is the participant’s responsibility to attend sessions to achieve the best results.
Attendance and Make-Up Classes
19. Catch-Up Classes: We offer catch-up classes but do not provide refunds or credits for missed training. It is your responsibility to attend the classes you book. If you cannot commit, you risk losing your spot to a student on the waiting list.
20. Sickness Policy: If you are sick and cannot attend a class, you can schedule a catch-up class at any location within three months. Credits for missed classes are not offered; it is your responsibility to catch up.
21. Class Booking and Attendance: All students must use the KMS app to book their classes and record attendance. It is the responsibility of the student or the student’s guardian to ensure classes are booked and attendance is registered through the app. This is an integral part of our grading process, and consistent use of the app is required to track attendance and participation. All members must have an account with Mindbody, with profiles associated for each member. The app will give notifications and also allow them to sign on to our free members events, which are a benefit of the 1-year Association/Support Membership fee.
Grading Policy
22.Grading Schedule: Gradings are conducted every 4 to 6 months. This period may vary based on the progress and readiness of students.
23. Criteria for Grading: Grading is based on attendance, good behaviour, and passing a test. Students are evaluated on their skills, discipline, and overall performance.
24. Stripes for Progress: In between official gradings, stripes are awarded to signify growth towards the next rank. These are given out in class to recognise ongoing progress.
25. Grading Outcome: If a student does not pass or meet the criteria in some form, they will be given an opportunity to correct the deficiencies within a set time determined by the instructor. They may resit the exam in full or in part, or correct the behaviour, after which they can progress.
26. Grading Ceremonies: The grading ceremony happens after the official testing process, typically within a few weeks to a month. For those who do not pass immediately, certificates and belts may be issued in a standard class setting.
27. Continuous Issues: If a student consistently shows issues, they will be held back in their current stage/belt until they demonstrate the necessary growth. This policy applies to both children and adults.
Student Requirements
28. Timeliness and Preparedness: All students must arrive at training early, in their uniform (particularly kids), and be ready to start on time. No late starters will be permitted. Students must log into class on the KMS app beforehand to ensure their attendance is recorded and they are prepared for training.
29. No Watches, Jewelry, and Obstructions: Students are not permitted to wear watches, jewelry, or any items that may get in the way during training. These items can pose safety risks and distractions and must be removed before class.
30. Uniform and Gear: All students must have the required training equipment and uniform for their classes. Equipment and uniforms can be purchased through KMS or from external vendors as long as they meet the required standards. Students without the proper equipment or uniform may not be allowed to participate in training.
General Terms
31. Product Sales Terms: All product sales are final and no refunds will be issued. We allow exchanges for sizing or other reasonable issues but not if the product is disliked after selection. All items must be in their original, unused condition for exchanges.
32. Separation of Fees: The Program/Training Fee covers only the weekly training sessions at the specified venue. The Association and Support Membership and equipment costs are charged separately and are mandatory for all students. While these are billed separately, all three components (training fee, membership, and equipment) must be active and current for participation in classes.
33. Liability Waiver: By joining the school, you agree to assume all risks associated with training and release KMS from any liability arising from injuries sustained during training.
34. Policy Changes: KMS reserves the right to update and modify these terms and conditions as necessary. Members will be notified of any significant changes.
35. Privacy Policy: Your personal information will be kept confidential and used solely for the purposes of managing your membership and improving our services. We do not store credit card information; it is encrypted and processed through secure systems like Mindbody.
36. Media Consent: By becoming a member, you consent to the use of photos and videos taken during classes for promotional purposes unless you notify us otherwise in writing.
37. Waiver Agreement: By agreeing to these terms and conditions, you acknowledge and accept the waiver included herein, releasing KMS from liability for any injuries or damages incurred during training.
Effective Date
38. Implementation Period: These terms and conditions come into effect immediately. We will allow students a month to acclimatise and adjust to these new terms during this transition period.
